AGB - General Terms and Conditions

1. general terms and conditions / scope of application

1.1 The company abaco GmbH (hereinafter referred to as abaco) operates under the www.austriabooking.at (hereinafter referred to as the "Portal") and all affiliated partner sites offer a publication service for accommodation providers, hereinafter referred to as "accommodation".

abaco is not a travel agency or provides similar services, abaco merely provides the portal with the corresponding advertising space on which accommodations are given the opportunity to market their own services. Inquiries, reservations, bookings and payments are made directly on the accommodation's home page at 100%.

abaco does not participate in a booking with the accommodations and does not charge any commission. For the publication of the services of the accommodations, abaco charges the accommodations fixed amounts/month.

abaco is a publishing and advertising portal.

As a rule, abaco does not conclude a direct contract with the accommodations. abaco maintains contractual relationships with the PMS (Property Management Systems) active in Austria, which in turn address their customers, on the abaco portal www.austriabooking.at to advertise.     

1.2 These GTC apply to all non-binding reservation inquiries as well as to binding bookings of accommodation via the Internet portal. At the same time, the cancellation conditions of the accommodations and their GTC also apply as soon as the searcher is on their site.

2. object of performance

2.1 Accommodation

2.1.1 The accommodation has the option of creating a user account (hereinafter referred to as "account") on the Internet portal. As a rule, the data available in the accommodation's PMS system is transferred automatically.

abaco assumes no liability for the accuracy of the data provided by the accommodations; this is the sole responsibility of the accommodation.

The accommodation itself is responsible for the data it publishes on the portal; abaco does not check this data.

abaco accepts no liability for this data.

2.2 Customer

2.2.1 The customer (seeker) has the opportunity to find out about offers from various accommodations on the portal.

If the customer has found an offer that suits them, they express their interest on the booking page provided by the accommodation.

The customer then books directly on the accommodation's website or on the corresponding online page of the accommodation through the technical means provided by the accommodation, usually channel managers of the PMS systems.

All further steps from booking confirmation to payment take place physically at the accommodation or in its IT environment.

In principle, contracts are only concluded between the accommodation and the person making the booking; accordingly, the general terms and conditions of the accommodation apply, including all cancellation conditions from this step onwards.

All customer data is stored and/or processed by the accommodation. The accommodation is responsible for all data protection issues.

abaco does not have any customer data and does not request it.

3. customer ratings

3.1 abaco refers to the usual rating portals for customer ratings.

4. inquiry/booking/reservation

4.1 All inquiries, bookings or reservations are made directly with the accommodation. All changes must also be made with the accommodation.

abaco is not technically involved in any of these steps.

abaco will inform the customer of this on the portal.

5. information about the accommodation

5.1 All information about the accommodation and the detailed description of the accommodation is based on the accommodation's own information. abaco has no influence on this information and accepts no responsibility for its accuracy and completeness.

As a rule, this information is transferred to the portal via the portal's data interface to the PMS systems.

5.2 The categorization of the accommodation offered is based on abaco's own classification of the accommodation. The classification therefore merely provides a subjective indication of the standard and facilities of the accommodation. abaco accepts no responsibility for this.

6. ranking / list of accommodations

6.1 After a search query, the portal compiles the list of accommodations found according to the desired search criteria, the order is random and arbitrary.

Searchers can also filter the "Recommendations" list according to their own criteria (e.g. "Price per night") and other criteria.

7. data protection

7.1 abaco does not collect, process or use any personal data of the customer. Personal data is processed exclusively by the accommodation providers, in which case their general terms and conditions apply.

7.2 Further information on data protection and the handling of personal data can be found in the privacy policy.

8. marketing

8.1 The portal is a marketing platform for accommodation in Austria and promotes it through various measures such as SEO and SEA activities on "Google", social media platforms or print media.

9 Warranty and liability

9.1 All information provided by the accommodation has been compiled with the utmost care. However, no liability can be accepted for any errors in data entry or data transmission. The transfer of data to other data carriers, even in extracts, or the use for purposes other than those intended here is only permitted with the express permission of the portal.

10. miscellaneous

10.1 Austrian law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods and the conflict of laws rules of private international law.

10.2 The European Commission's online dispute resolution platform can be accessed via the following link https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.show&lng=DE . The portal does not participate in dispute resolution proceedings before a consumer arbitration board and is not obliged to do so.

10.3 The place of performance is Salzburg. Salzburg is agreed as the place of jurisdiction for merchants or persons who do not have a general Austrian place of jurisdiction. Otherwise, the statutory place of jurisdiction shall apply.

10.4 The use of the Internet portal and its content is only permitted for individual information, inquiries about offers and reservations. The data material of the accommodation is protected by copyright, so that reproduction (in particular by automated reading, so-called "scraping") is prohibited. In particular, the use of the data material (such as query results in particular) for the purpose of further brokerage is also prohibited.

10.5 Links contained on this website to websites of other companies (third-party providers) are provided solely in the interest of the customer. If the customer clicks on such a link, he will leave the portal website. The portal has no influence on the content of third-party websites. Therefore, the portal cannot accept any liability for the accuracy, completeness or harmlessness of this third-party content.

10.6 The Portal reserves the right to amend these General Terms and Conditions for Account Holders in the future. The Agent shall send the accommodation with an account the new version of the General Terms and Conditions by e-mail no later than four weeks before they are scheduled to come into force and shall inform the accommodation of the intended changes. If the accommodation does not object within four weeks of receipt of the aforementioned notification, the new version of the General Terms and Conditions shall be deemed accepted. The portal shall inform the accommodation of the possibility to object as described above and the consequences of failing to object.

10.7 If any provision of this Agreement is invalid or unenforceable, that provision shall be construed so as to be consistent with applicable law and to best reflect the original intentions of the parties. The remainder of this Agreement shall not be affected thereby.
